These Terms and Conditions (“Terms”) govern your access to and use of LoadBearing.io (“Company,” “we,” “our,” or “us”) and all related services.

By accessing or using our Services, you agree to be bound by these Terms.

1. SERVICES

LoadBearing.io provides website design, hosting, CRM systems, automations, SMS/email communication tools, lead tracking systems, and related digital infrastructure for contractors and service-based businesses.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time.

2. SUBSCRIPTION & BILLING

All Services operate on a recurring subscription basis.

Subscriptions automatically renew each billing cycle unless canceled prior to the renewal date.

Billing Authorization

By subscribing, you authorize LoadBearing.io to automatically charge your payment method on file for:

Subscription fees

Hosting fees

Software access

Add-ons or upgrades

Usage-based charges (SMS, email, call minutes, automation usage)

Reactivation fees

Applicable taxes

You agree that charges may be processed automatically without additional notice.

You are responsible for maintaining valid payment information.

Failed Payments

If a charge fails, we reserve the right to:

Retry billing

Suspend services

Terminate access

Charge backup payment methods on file

We are not responsible for business losses resulting from suspension due to failed payment.

3. NO REFUNDS

All payments are final.

We do not provide refunds for:

Partial billing periods

Unused services

Dissatisfaction

Performance expectations

Failure to use the system

By subscribing, you acknowledge and accept this no-refund policy.

4. SMS MESSAGING TERMS

If you use our SMS or messaging features, you agree to the following:

Client Responsibility for Consent

You are solely responsible for obtaining express written consent from all recipients before sending SMS or automated messages.

You agree to comply with:

TCPA

CAN-SPAM

CTIA guidelines

All applicable federal and state laws

LoadBearing.io does not verify recipient consent.

Message Delivery Disclaimer

We do not guarantee:

Message delivery

Message timing

Carrier acceptance

Filtering avoidance

Platform uptime

SMS delivery is dependent on third-party carriers and infrastructure.

We are not liable for missed messages, delayed responses, or failed automations.

Messaging Costs

Message and data rates may apply to recipients.

You are responsible for all messaging charges generated from your account.

Prohibited Use

You may not use the platform for:

Spam

Unsolicited marketing

Illegal promotions

Harassment

Fraud

Violation may result in immediate termination.

5. CANCELLATION POLICY

You may cancel your subscription at any time prior to your next billing date.

Cancellation must be submitted in writing or through your account portal.

Upon cancellation:

Services will remain active until the end of the billing cycle

No refunds will be issued

Hosting and system access may be discontinued

Websites may be taken offline

We are not responsible for data retention after cancellation.

6. WEBSITE & SYSTEM ACCESS

Unless otherwise agreed in writing:

Websites and system infrastructure are provided as part of your active subscription

Continued access requires active payment

Upon termination, hosting may cease and systems may be disabled

We are not obligated to maintain, transfer, or continue hosting assets after cancellation.

7. NO PERFORMANCE GUARANTEES

We do not guarantee:

Revenue

Lead volume

Search rankings

System uptime

Business growth

Automation performance

The Services are provided “AS IS” and “AS AVAILABLE.”

8. THIRD-PARTY SERVICES

Our Services rely on third-party platforms and providers.

We are not responsible for:

API failures

Carrier filtering

Hosting outages

Payment processor issues

Software bugs outside our direct control

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

LoadBearing.io shall not be liable for:

Lost profits

Lost leads

Business interruption

Data loss

Missed texts or calls

Regulatory penalties

Indirect or consequential damages

Our total liability shall not exceed the amount paid by you in the 30 days preceding the claim.

10. INDEMNIFICATION

You agree to indemnify and hold harmless LoadBearing.io from any claims arising from:

Your violation of messaging laws

Improper data collection

Customer disputes

Government fines

Your misuse of the Services

11. CHARGEBACK & DISPUTE POLICY

By agreeing to these Terms, you agree to contact LoadBearing.io to resolve billing issues before initiating a chargeback.

Improper chargebacks may result in:

Immediate account termination

Collections action

Recovery of associated fees

12. DATA & SECURITY

While we use commercially reasonable safeguards, we do not guarantee:

Absolute data security

Prevention of breaches

Continuous uptime

You acknowledge inherent risks in internet-based services.

13. ACCOUNT TERMINATION

We may suspend or terminate accounts for:

Non-payment

Fraud

Illegal activity

Abuse

Messaging violations

We are not liable for business interruption resulting from termination.

14. GOVERNING LAW & ARBITRATION

All disputes shall be resolved through binding arbitration in the State of Michigan.

You waive participation in class actions.

15. MODIFICATIONS

We may update these Terms at any time.

Continued use of the Services constitutes acceptance of updated Terms.
